These Terms of Service ("Terms") form a binding legal agreement between you ("you", "the User") and Zydrunas Salcius, a private individual based in Lithuania, operating the website PldWebApp (the "Service").
By ticking the acceptance box, clicking "I agree", uploading a file, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, you must not use the Service.
1. Description of the Service
The Service is an online tool that allows the User to upload certain configuration or parameter files (such as .pld or .txt files), select modifications, and download a modified version of the file. The Service is provided strictly as a technical processing tool. The operator does not inspect, endorse, certify, or guarantee any particular use of uploaded or generated files.
2. Eligibility
To use the Service, you confirm that:
- You are at least 18 years old and have full legal capacity to enter into a binding contract;
- You are accessing the Service from a jurisdiction in which doing so is lawful;
- You are not subject to any sanctions, export controls, or other legal restrictions that would prohibit your use of the Service.
3. User responsibilities and warranties
By using the Service, you represent and warrant that:
- Ownership. You are the lawful owner of the equipment to which any uploaded or downloaded file relates, or you have the explicit, documented authorisation of the owner to perform the modifications you request.
- Right to upload. You have the legal right to upload, process, and modify the files you submit, and doing so does not violate any contract, licence, end-user agreement, terms of use, intellectual-property right, or third-party right.
- Personal, non-commercial use. Files generated by the Service are for personal use only, on equipment you own. You will not redistribute, resell, sublicense, or commercially exploit the modified files.
- Lawful purpose. You will use the Service only for purposes that are lawful in your jurisdiction, and you will not use it to:
- Violate any applicable law, regulation, or court order;
- Bypass safety, emissions, or other regulatory controls in any way that is unlawful in your jurisdiction;
- Operate equipment on public roads or in commercial contexts where the modification would render such operation unlawful;
- Infringe the intellectual property or contractual rights of any third party, including equipment manufacturers;
- Damage or endanger persons, property, or the environment.
- No misrepresentation. You will not use the Service to commit fraud, including misrepresenting equipment status, serial numbers, or warranty/insurance information to third parties.
- Compliance with manufacturer terms. You acknowledge that modifying files may breach the warranty, service agreement, or end-user terms imposed by the manufacturer of your equipment, and that any such consequences are your sole responsibility.
You agree that you, and not the operator of the Service, bear full legal responsibility for your use of uploaded and generated files.
4. Prohibited use
You must not:
- Upload files that you do not own or are not authorised to modify;
- Upload malware, exploits, or files designed to compromise the Service;
- Attempt to reverse-engineer, scrape, overload, or interfere with the Service;
- Use automated tools to access the Service without prior written permission;
- Use the Service to provide a commercial file-modification service to third parties;
- Resell, redistribute, or share access to the Service or files produced by it.
The operator may, at its sole discretion, refuse service, delete files, and terminate access without notice for any suspected violation of these Terms.
5. Payments, refunds, and digital-content delivery
- Prices for modifications are displayed before payment. Payments are processed via Stripe.
- The Service provides digital content delivered immediately within the meaning of Article 16(m) of Directive 2011/83/EU.
- By starting a paid modification, you expressly consent to immediate performance of the contract and expressly acknowledge that you thereby lose your 14-day right of withdrawal under EU consumer law.
- Because of the nature of the Service, all sales are final and refunds are issued only where:
- Processing failed due to a verified technical fault of the Service, and
- No usable output file was delivered to you.
- Refund requests must be submitted within 14 days of the transaction to the contact address in Section 14.
6. Intellectual property
- All rights in the Service itself (software, design, text, branding) are owned by the operator and protected by applicable law.
- You retain ownership of the files you upload. You grant the operator a limited, non-exclusive, royalty-free licence to process those files solely for the purpose of providing the Service.
- The Service is not affiliated with, endorsed by, or sponsored by any equipment manufacturer. Any references to third-party products or trademarks are for identification only.
7. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by applicable law. The operator specifically disclaims any warranties of:
- Merchantability or fitness for a particular purpose;
- Accuracy, completeness, or correctness of output files;
- Compatibility of output files with your equipment;
- Uninterrupted, error-free, or secure operation;
- That use of the Service or its output will comply with any law, regulation, manufacturer requirement, or contractual restriction applicable to you.
You use the Service and any output entirely at your own risk. You are solely responsible for testing, validating, and verifying any modified file before using it on real equipment.
Nothing in this Section limits warranties that cannot be excluded under mandatory consumer-protection law applicable to you.
8. Limitation of liability
To the maximum extent permitted by applicable law:
- The operator shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to: loss of profits, loss of data, loss of use, damage to equipment, damage to property, personal injury, regulatory fines, warranty loss, or third-party claims, arising out of or in connection with your use of the Service or any output file.
- The operator's total aggregate liability for any and all claims related to the Service shall not exceed the total amount you paid for the specific transaction giving rise to the claim, or EUR 50, whichever is lower.
- Nothing in this Section excludes or limits liability for death or personal injury caused by gross negligence or intentional misconduct, or any other liability that cannot be excluded under mandatory law.
9. Indemnification
You agree to indemnify, defend, and hold harmless the operator from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service or any output file;
- Your breach of these Terms;
- Your violation of any law, regulation, or third-party right (including manufacturer terms, intellectual property, contract, or warranty);
- Any claim by a third party (including any equipment manufacturer) that your use of the Service or its output caused harm or violated their rights.
10. Termination
The operator may suspend or terminate your access to the Service at any time, with or without notice, including if it reasonably suspects a breach of these Terms or unlawful use. Sections 3, 5(d)–(e), 6, 7, 8, 9, 11, and 12 survive termination.
11. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict-of-law rules. Any disputes shall be submitted to the competent courts of Lithuania.
If you are a consumer resident in the EU, you also have the right to rely on mandatory consumer-protection provisions of the law of your country of residence, and to bring proceedings in the courts of your country of residence.
EU consumers may also use the European Commission's Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
12. Privacy
Processing of personal data in connection with the Service is described in the Privacy Policy, which forms part of these Terms.
13. Changes to these Terms
The operator may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes will be communicated through the Service.
